The Architectural Review Committee ("ARC") was created to enhance property values by requiring conformity to certain standards of construction, visual appeal, uniformity and design. The Covenants, Conditions and Restrictions ("CC&Rs") provide that "no building, fence, wall, structure, improvement, exterior appurtenance, or exterior corporeal hereditament, except landscaping (landscaping defined as "living plants, trees, shrubs, flowers, etc., and utilization of non-living material necessary for growth, i.e., bark mulch, etc. Trellises, window boxes, arbors, and permanent brick borders must have ARC approval. Landscape timbers and bricks without mortar do not need ARC approval unless they exceed a height of one (1) foot) shall be commenced, erected, placed, or altered on any Lot, nor shall any exterior addition to or change or alteration, other than landscaping, be made to the Lot, improvements, appurtenances, or corporeal hereditaments until the construction plans and specifications describing the nature, kind, shape, height, materials and a plot plan showing the location of same, have been approved in writing.

It is the general purpose of the ARC to approve or disapprove applications made to it for proposed alterations, additions or changes to be made to the exterior of the house and/or lot itself. Landscaping does not require ARC approval unless the configuration of the ground changes (i.e., berms, fill dirt, etc.)

Procedure

A "Request for Home Improvement Approval Form" must be completed in its entirety and mailed to the address indicated on the form. All pertinent information such as plans, specifications, building permits, locations of the proposed improvements must be indicated on a copy of the survey, etc. and all of these items should be included with the application.

The architectural review forms are available from your management company.The ARC cannot respond to verbal requests for approval - all applications must be made in writing.

Plans for the implementation of the proposed improvements) should allow for the time required to complete the approval process. No construction should begin prior to approval. Additionally, should your application be submitted after the fact of construction, the ARC is not required to provide approval and there is no limitation of time for the review. You may be required to remove said improvements.

Guidelines

The following are guidelines adopted by the ARC to specify their standards, requirements and thought processes used in evaluating an application. The guidelines may be amended from time to time as the circumstances, conditions or opinions of the ARC dictate. It should be noted that each application is considered on its own merit and that the ARC may grant a variance from these guidelines and/or from certain provisions of the CC&RS. The ARC has the right to deviate approval for a similar improvement based on the proximity of a property to main boulevard on the visual relativity of the site to the overall development. As an example, a home located on the perimeter of the development may be permitted to have a certain styled storage building, whereas on a main entry boulevard and depending on the configuration of the lot, this same may not be approved. The intent being to maintain overall integrity within areas of higher visual impact.

It should also be noted that ARC approval is required prior to the installation or construction of the improvement or change. If an improvement is made without ARC approval, the Board of Directors has the legal right to enforce its removal.

1.0 Outbuildings

An "outbuilding" is defined as any structure which is not attached to the main structure. This definition does not include bonafide additions to the main residences or garages wherein an actual opening to the main structure exists, but does include storage sheds, gazebos, and playhouse/forts.

All storage sheds, gazebos and playhouse/forts have height and location restrictions and must be approved prior to construction. These are approved on an individual basis depending on the lot they are to be built upon.

2.0 Basketball Goals/Portable Play Equipment

All Basketball Goals[Portable Play Equipment must be approved prior to placement and must be maintained in excellent condition at all times. There are guidelines as to height, size and storage of equipment.

3.0 Patio Covers

All patio covers must be approved prior to construction. Please fill out the ARC form completely with materials, color and location choices as well as a copy of your survey stating the exact location and dimensions of the improvement. The patio covers cannot interfere with utility easements or drainage areas.

4.0 Room Additions

Exterior materials and colors should match the house as much as possible and detailed plans must be submitted to the ARC. Room additions may not encroach into any utility easement unless the utility companies involved have granted their written consent to such encroachment. These are approved on an individual basis.

5.0 Exterior Painting/Siding

Any changes to the color of the exterior (siding, trim, doors) of your home must be approved prior to the change. There are specific approved builder colors and the color must match or complement the brick on the home. The ARC will approve additional colors on an individual basis. When filling out the ARC form, please attach color samples of the colors you wish to use and also list the brick color on the home.

6.0 Storm Windows, Solar Screens and Storm/Screen Doors

Providing the frames of these are of a color compatible with the exterior house colors, storm windows, solar screens and storm or screen doors should receive ARC approval.

7.0 Decks

Decks must be submitted for approval before construction. Please fill out the ARC form and include a copy of the survey stati-.ig exact location and dimensions as well as materials and colors being used. The decks should not encroach into drainage or utility easements.

8.0 Swimming Pools and Spas

Swimming pools/spas must have ARC approval before the construction begins. Please attach a copy of the survey showing exact location of pool/spa. It must not encroach on utility or drainage easements. No above ground pools are permitted. Pool buildings will be approved on an individual basis. Pools must be maintained, at all times, in a sanitary and healthful manner.

9.0 Satellite Dishes

All satellite dishes must have ARC approval before installing. There are guidelines regarding the location, dimensions and color of the satellite dishes as well as encroachment areas. Please attach a copy of the survey stating these areas when submitting for approval.

10.0 Fence and Fence Extensions

Fence and fence extensions must be approved by the ARC prior to construction. There are specific dimensions and materials allowed and must be approved by all neighbors involved. All fences in the subdivision must be uniform in nature. Please attach a survey for location of specific changes.

11.0 Artiflcial Vegetation, Exterior Sculptures, and Similar Items.

11.1 Statues, sculptures, etc. outside the fenced portion of the lot shall not exceed three feet (3') in height and shall be in keeping with the atmosphere and appearance of the immediate neighborhood.

11.2 Benches, burglar bars and gates will be reviewed on an individual basis.

11.3 House numbers may be placed on the house but not any type of free-standing structure in front yard.

11.4 No artificial vegetation shall be permitted on the exterior of any portion of the lot.

11.5 Christmas decorations, including lighting, may not be placed on the house or in the front yard prior to Thanksgiving Day, and must be removed no later than January 3 1. All other seasonal decorations shall be limited to a maximum thirty (30) day period.

11.6 No advertisement signs, other than those used to aid the sale of property, are permitted.

11.7 Portable planters visible from the street shall consist only of those items commonly accepted as planters.

11.8 Umbrella covered tables are prohibited if visible from the fronting street.

11.9 Bench type seating in the front yard shall consist only of iron or wood-slat stationary benches and must be kept in their original condition. Metal gliders are prohibited.

12.0 Exterior Lighting

12.1 Additional exterior lighting should not be of a wattage or lumen count which will affect neighboring homes.

12.2 Directional lights or floodlights must be aimed so as not to shine in the windows of neighboring homes.

12.3 Low voltage landscape lighting should receive ARC approval.

12.4 Security, mercury vapor, or fluorescent lights must be attached to the front of the house, preferable the garage. Mercury vapor, fluorescent, and sodium halite may be permitted in back as long as it in no way shines onto adjacent property.

12.5 Yard lights may be gas or electric, single lamp only and maximum height of six feet (6'). Must be in front or back. Gas or electric lights must be black, brown or white, depending on the color of the house. The determination of suitable color will be the decision of the ARC.

13.0 Outdoor Carpeting

Outdoor carpeting must be approved by the ARC. Earth tone colors are acceptable, no green or blue carpet. Can only be installed on porch area-no driveways, etc. Visibility from front street will be considered.

14.0 Burglar Bars

Acceptable, provided they are in harmony with house and painted to match exterior trim.

15.0 Landscaping/Lot Maintenance

15.1 Timbers, bricks, stone (use native Texas stone), flower bed borders, landscape lights, trellises and sprinklers may be approved subject to ARC review.

15.2 Must compliment style and architecture of home and conform to color scheme of immediate neighborhood.

15.3 Each owner of property within the subdivision shall keep all shrubs, trees, grass, and plantings of every kind on his property, including setback areas and planted areas between set- back lines and the street curb and on any property located between the boundary line of his property and the street (public and private) on which such property abuts, neatly trimmed, properly cultivated and free of trash, weeds, and other unsightly material.

15.4 The area between the sidewalk and the street curb shall be planted only with grass in order to maintain uniformity, consistency and curb appeal throughout the subdivision.

15.5 Any plantings other than grass which are currently in place between the sidewalk and street shall remain so until such time as they become dead or unsightly. At such time the plantings shall be removed and the replacement of said plantings is prohibited.

15.6 No trees shall be removed, except for diseased or dead trees or for safety reasons from any lot without prior consent of the ARC.

16.0 Antennas (Amended Fall of 1994)

Antennas must be approved prior to installation. Please attach a survey to show exact location of antenna. These are reviewed on an individual basis and must be installed on back side of house, lower than center roof line (on 2-story's only) and installed to the best of owner's ability so as not to be visible from any fronting street. Antennas and other apparatus intended for the transmission of radio, satellite or other signals are prohibited.

17.0 Swing Sets

Swing sets must be approved prior to construction. Please attach a survey to show exact location and dimensions of swing sets. They may not be visible from fronting street. These are approved on an individual basis and lot size/dimensions are taken into consideration.

18.0 Driveway Extensions/Sidewalks

Reviewed on an individual basis. Please submit survey with approval form showing exact location and dimensions.

19.0 Garage Conversions, Carports, Detached Garages

Garage conversions and carports are prohibited. Driveways can never be removed from front yard even if alternate garage is built. All garages must have doors which shall be constructed of steel or any other material approved by the ARC and shall be harmonious in quality and color with the exterior of the appurtenant dwelling.

20.0 Air Conditioning Units

Must not be visible from street and must be contained within the fenced portion of the lot. This also includes window units.

21.0 Window Shades/Awnings

21.1 Canvas awnings will not be permitted to be installed on windows to reduce solar exposure unless they are on the back side of the house on an interior lot and not visible at all from any street. On a corner lot or lot that backs onto a street, canvas awnings will not be permitted at all. When allowed, they must be earth tone colors, and must be kept in excellent condition at all times or will be subject to immediate removal upon notification by the HOA of their unacceptable condition.

21.2 Awnings will still be allowed for use on playhouses and patio covers, provided they also comply with aforementioned requirements for proper location and color.

21.3 Metal and wooden slat-type shades may be allowed by the ARC if they are deemed necessary in reduction of solar exposure and installation on appropriate windows will be determined by the ARC. Only colors that are harmonious with the house color or brick will be allowed.

21.4 Within ninety (90) days of occupying the home, it is required that either coverings manufactured solely for the purpose of covering windows be installed or that the windows remain uncovered. After the initial ninety

(90) day period, other coverings, i.e., sheets, paper, etc. are prohibited. Tin foil and newsprint are prohibited at all times.

THE ATTACHED GUIDELINES HAVE BEEN ACCEPTED AND APPROVED BY THE WHITE OAK LANDING HOMEOWNER'S ASSOCIATION BOARD OF DIRECTORS FOR IMPLEMENTATION AND ENFORCEMENT THIS 1 ST DAY OF JULY 1994.
