P R O X Y Q U E S T I O N YOU ARE RECEIVING IN THE MAIL YES/NO To allow the individual annexation of 15 homes within the immediate subdivision of White Oak Landing who may now or in the future volunteer to be admitted to the Homeowners Association. This would only apply to the 15 homes within the current borders of White Oak Landing subdivision that do not belong to the White Oak Landing Homeowners Association as of 2001. EXPLANATION OF PROXY QUESTION When White Oak Landing was originally developed, due to either the developers inexperience or to a lack of funds, the deed restrictions that create the Homeowners Association were apparently not correctly put in place before some of the homes were sold to homeowners. Because of this, there are some 15 homes in the subdivision that should have been included in the Homeowners Association that are not. These homes pay no dues into the Association, cannot use the park or pool, and are not controlled by the same deed restrictions that cover the rest of the subdivision. From time to time, one of the residents of these homes asks to join the Association. In order to do this, their home must be annexed into the Association. A two-thirds vote of the subdivision is required to allow any of these homes to be annexed. Voting for this proposition would give the Board of the Homeowners Association the right to annex any of these 15 homes whenever any of these homeowners volunteers to join the Association. Homes that are annexed will pay the same dues as all other residents. They will be governed by the same deed restrictions as the rest of the subdivision. Once annexed, the homes cannot later withdraw. This deals only with homes in the immediate subdivision. Furthermore, this CANNOT be used to annex any homes other than the 15 homes located within the borders of the subdivision of White Oak Landing which are not currently part of the HOA. |
